Terms of Service (Pesterless)

These Terms of Service (“Terms”) govern your access to and use of Pesterless (the “Service”), including our website, web app, and any related services such as reminder emails. By creating an account, accessing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) Who we are

2) Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
If you use the Service on behalf of a business or another person, you confirm you have authority to bind them to these Terms.
3) Your account
Account security
You are responsible for:
- Keeping your login details secure
- Any activity under your account
- Ensuring your email address is accurate and accessible
Accuracy of information
You agree not to provide false information or impersonate others.
Account access
We may suspend or restrict access if we reasonably believe:
- Your account is being used fraudulently or unlawfully
- Your use risks harm to the Service or others
- You materially breach these Terms
4) The Service
Pesterless is a minimalist personal CRM that helps you store contact details, notes, and follow-up reminders.
We may change, add, or remove features at any time. We’ll try to ensure changes don’t materially reduce core functionality without good reason, but the Service may evolve as we improve it.
Beta and experimental features
Some features may be labelled beta or experimental. These are provided “as is” and may be changed or removed.
5) Subscriptions, billing, and cancellation
Plans
Some features may require a paid subscription. Details of plans and pricing will be shown at checkout or on the pricing page.
Billing
If you subscribe:
- You authorise us (via our payment processor) to charge your payment method on a recurring basis (monthly or annually, depending on your plan).
- Taxes may be added where required.
Renewals
Subscriptions renew automatically unless cancelled before the renewal date.
Cancellation
You can cancel at any time through your account settings or the billing portal (where available). Cancellation takes effect at the end of your current billing period unless stated otherwise.
Refunds
Unless required by law, fees are generally non-refundable. If you believe there has been a billing error, contact us at hello@pesterless.com and we’ll investigate.
Price changes
We may change prices. If you have an active subscription, we will provide reasonable notice of changes and tell you when they take effect.
6) Your content and contact data
Your content
“Content” includes any information you add to the Service, such as notes, reminders, tags, and uploaded data.
You retain ownership of your Content. You grant us a limited, worldwide, non-exclusive licence to host, store, process, and display your Content solely to provide and improve the Service.
Third-party personal data (your contacts)
If you add information about other people (your contacts), you represent and warrant that:
- You have a lawful basis to store and process that data (for example, legitimate interests in professional networking), and
- Your use complies with applicable data protection laws.
You are responsible for the content and accuracy of contact data you upload or enter.
Sensitive information
Please do not store highly sensitive personal information in Pesterless (for example, government IDs, special category data, financial account numbers) unless you have a clear lawful basis and it’s strictly necessary.
7) Acceptable use
You must not (and must not attempt to):
- Use the Service for unlawful, harmful, or abusive purposes
- Send spam or unsolicited messages via the Service
- Store or transmit malware, exploit code, or harmful content
- Reverse engineer, copy, or circumvent security or access controls
- Interfere with or disrupt the Service (including excessive automated requests)
- Access accounts or data you do not own or have permission to access
We may suspend or terminate accounts for violations.
8) Integrations and third-party services
The Service may rely on third-party providers (for example, for hosting, email delivery, authentication, and payments). These providers may have their own terms and policies.
We are not responsible for third-party services that are not under our control, including outages, interruptions, or changes to their offerings.
9) Intellectual property
We own (or license) all rights in the Service, including software, design, branding, logos, and documentation.
You may not use our branding without written permission.
We may use aggregated, anonymised insights to improve the product, provided they do not identify you or your contacts.
10) Availability and support
We aim to keep Pesterless available and reliable, but we do not guarantee uninterrupted operation.
We may perform maintenance, updates, or emergency fixes that could temporarily affect availability.
Support is provided as described on our website or within the Service, and may vary by plan.
11) Disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available”.
We do not warrant that:
- The Service will be error-free or uninterrupted
- The Service will meet every requirement you have
- Data will never be lost (you are encouraged to keep exports/backups where available)
Nothing in these Terms limits any consumer rights that cannot be excluded under applicable law.
12) Limitation of liability
To the maximum extent permitted by law, we will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business, goodwill, or opportunity
- Loss of data arising from your use of the Service (except where caused by our breach of legal duties that cannot be excluded)
Where we are liable to you, our total liability for claims relating to the Service will be limited to the greater of:
- The amount you paid us for the Service in the 12 months before the event giving rise to the claim, or
- £100
This does not limit liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under law.
13) Indemnity (business users)
If you use the Service for business purposes, you agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your Content (including contact data you upload)
- Your breach of these Terms
- Your unlawful use of the Service
14) Termination
By you
You may stop using the Service at any time and may request account deletion.
By us
We may suspend or terminate your access if you:
- Breach these Terms
- Use the Service unlawfully
- Create risk or harm to the Service, users, or others
Effect of termination
Upon termination:
- Your right to use the Service ends
- We may delete your Content after a reasonable period, subject to legal retention obligations
15) Data exports and deletion
Where available, you may be able to export your data. You can request deletion of your account and associated data by contacting hello@pesterless.com (or using in-app tools if provided).
We may retain limited information where required by law (for example, billing records) or for legitimate security purposes for a limited period.
16) Changes to these Terms
We may update these Terms from time to time. If changes are significant, we’ll provide a clear notice (for example, in-app or by email). Your continued use of the Service after changes take effect means you accept the updated Terms.
17) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also benefit from mandatory consumer protection laws in your country of residence.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer law requires otherwise.
18) General
Entire agreement
These Terms and any referenced policies form the entire agreement between you and us regarding the Service.
Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver
If we do not enforce a provision, it does not waive our right to do so later.
Assignment
You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, or sale of assets.
